1. Introduction
Our objective is to keep this Agreement clear and understandable; however, some legal language is necessary for legal reasons.
2. Your Acceptance of this Agreement
These Terms of Service are entered into by and between you and Gioia Concierge LLC (“Company,” “we,” “our,” or “us”). The following terms and conditions, along with any documents they explicitly incorporate by reference (collectively, “Terms of Service”), govern your access to and use of our services offered by Gioia Concierge.
By engaging with our services [or by indicating your acceptance when prompted], you agree to be bound by these Terms of Service. If you disagree with these Terms of Service, you must not access or use our services.
BY USING OUR SERVICES, YOU:
– ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE;
– REPRESENT AND WARRANT THAT YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH US;
3. Updates to Terms of Service
We may revise these Terms of Service from time to time at our sole discretion. All changes are effective immediately upon posting and apply to all access to and use of our services thereafter.
Continuing to use our services after changes are posted signifies your acceptance of those changes. You are encouraged to check this page regularly to stay informed of any updates, as they are binding on you.
4. Your Responsibilities
You must ensure that all individuals who access our services are aware of this Agreement and comply with it. It is a condition of your use of our services that all information you provide is accurate, current, and complete.
YOU ARE SOLELY AND FULLY RESPONSIBLE FOR YOUR USE OF OUR SERVICES AND FOR YOUR COMPUTER, INTERNET, AND DATA SECURITY.
5. Prohibited Activities
You may use our services only for lawful purposes and in accordance with these Terms of Service. You agree not to use our services:
– In any manner that violates applicable federal, state, local, or international laws or regulations.
– For the purpose of exploiting or harming minors in any way.
– To impersonate or attempt to impersonate the Company, any staff member, another user, or any entity.
– To engage in conduct that restricts or inhibits anyone’s use of our services or may harm the Company or users.
6. Intellectual Property Rights
The services and their entire content, features, and functionality (including, but not limited to, all information and materials) are owned by the Company, its licensors, or other content providers and are protected by copyright, trademark, patent, and other intellectual property laws.
These Terms of Service allow you to use our services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, or create derivative works of our content without our express consent.
7. Our Rights
We reserve the right, without notice, to:
– Take appropriate legal action for any unauthorized use of our services; and
– Terminate or suspend your access to our services for any reason, including violations of these Terms of Service.
You waive and hold harmless the Company and its affiliates from any claims resulting from any action taken due to investigations by the Company or law enforcement.
8. Service Orders
All orders or transactions for services made through our platform are subject to additional terms:
– Your order is an offer to purchase services, subject to our acceptance. We may refuse orders at our sole discretion, even after a confirmation email is sent.
– Prices and promotions are subject to change without notice, and taxes or shipping charges will be added when applicable.
9. Payments
Payment is required upon completion of the service. Gioia Concierge will issue an invoice that must be settled within 48 hours from the date of the invoice. If a credit card is on record, we reserve the right to charge that card immediately unless the client provides written notice to the contrary.
Quotes, Deposits, and Fees: After you submit an inquiry, we will assess your request and service requirements to provide you with a quote for the estimated cost of the service. This may include the cost of our two-hour minimum charge along with a 50% deposit. Please note that your request cannot be confirmed until we receive the deposit. Even after payment, the job is not guaranteed until a Gioia Concierge staff member has been assigned to your service.
If a Gioia Concierge staff member picks up materials or supplies at your request during the service, you will be billed at the hourly rate plus a 10% handling fee. For heavy or large bulk items requiring a truck, an additional truck fee may apply.
Invoices that remain unpaid after 7 days will incur a 3.5% late fee. Should you need to cancel, if done within our policy window, your deposit will be refunded. Additionally, if a staff member is unable to provide the service, your deposit will also be refunded.
10. Cancellation Policy
We understand that unexpected delays can occur, necessitating schedule adjustments. If you need to cancel your appointment, we respectfully request at least 12 hours’ notice. Cancellations made less than 12 hours in advance will incur a 50% charge of the service if not rescheduled within 10 business days.
11. Service Fee
Please note that all credit card payments will incur a 3% service fee. Alternatively, clients may choose to make an ACH payment from their bank, which will not incur this fee; however, to facilitate this option, clients must email [email protected] to receive an updated invoice.
12. Meet and Greets
Clients may request meet and greet sessions to connect with potential staff members for specific services. The first 30 minutes are complimentary; however, any time beyond that will incur a charge at the hourly rate of the service.
